Terms of Carriage
1. About these terms
These terms apply to all services provided by Bramwell Logistics, 55 Colmore Row, Birmingham (“we”, “us”) to business customers (“you”). They apply to every job unless we agree otherwise in writing.
2. Quotes and bookings
Our quote is fixed for the job as you describe it to us. It is valid for 7 days. A booking is confirmed when we confirm it in writing, including by email or text. If the job changes (extra stops, different addresses, a heavier or larger load, waiting time or a different date), we may change the price and will tell you before we proceed.
3. Your responsibilities
You must give us accurate details of the goods, including weight, dimensions and number of items, and any special handling needs. Goods must be properly packed, labelled and secured for transport, and you must make sure there is safe access at collection and delivery, with someone present to hand over or sign for them. We do not carry dangerous goods (ADR), illegal goods, or goods that cannot be carried safely or legally in our vehicle. We may refuse any load that is overweight, unsafe or not as described.
4. Collection and delivery
Times we give are estimates unless we agree a fixed time in writing. If no one is available to receive the goods, we may charge for waiting time (the first 30 minutes are free), redelivery and storage. We confirm delivery with a signed delivery note.
5. Our drivers
Your job is carried out by one of our own vetted drivers. If we ever need to arrange cover, we will tell you first.
6. Payment
Invoices are payable on the terms agreed in writing with you. If none is agreed, payment is due 14 days from the invoice date. VAT is added where applicable. If you pay late, we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998. We may suspend work on any account that is overdue. Please raise any invoice query within 7 days of receiving it.
7. Cancellation
You may cancel without charge up to 24 hours before the booked collection time. After that, we may charge 50% of the price, and the full price once our driver has set off.
8. Loss and damage
We are responsible for loss of or damage to your goods while they are in our care, where it is caused by our fault. Our liability is limited to £1,300 per tonne, up to a maximum of £50,000 per consignment, unless you declare a higher value in writing before the job and we agree to carry it. We recommend you insure high-value goods yourself. We are not liable for indirect or consequential loss, such as lost profit or business. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
9. Claims
Please note any damage or shortage on the signed delivery note at the time of delivery. Written notice of a claim for damage must reach us within 3 working days of delivery, and for non-delivery or loss within 7 days of the expected delivery date. Claims should be sent to sales@bramwelllogistics.com.
10. Delays and events outside our control
We are not responsible for delay or failure caused by events beyond our reasonable control, such as severe weather, road closures, accidents, vehicle breakdown despite proper maintenance, or industrial action. We will tell you promptly and do our best to complete the job.
11. Right to hold goods
If you owe us money, we may keep your goods until payment is made, as the law allows.
12. Data protection
We handle personal information as set out in our Privacy Policy.
13. General
These terms are governed by the law of England and Wales, and its courts have jurisdiction over any dispute. If any part of these terms is found to be unenforceable, the rest still applies.
